Trump increased global tariffs by 5% in 24 hours: earlier 10%, now 15%; On Friday, the Supreme Court canceled all the old tariffs

Section 122 is part of a US law called the Trade Act of 1974. This law gives the US President the authority to immediately impose tariffs on imports if the country faces a sudden trade deficit or economic crisis.

Under this, the President can impose tariffs temporarily without a lengthy investigation process. Usually this tariff can remain in force for 150 days. During this time the government reviews the situation and takes further decisions.

According to NBC News, imposing a uniform global tariff of 15% on all the trading partner countries of the world would mean that the countries which have imposed higher tariffs will themselves be reduced.

Some products are exempt, such as certain agricultural products (beef, tomatoes, oranges), critical minerals, pharmaceuticals, some electronics, and passenger vehicles. The Trump administration said that this tariff will replace the old one and they will continue to try to make more money.

Nixon had imposed 10% global tariff 55 years ago

In the year 1971, there was a huge imbalance in trade and balance of payments between America and the world. America was continuously importing more and was able to export less, due to which the pressure on the dollar was increasing.

After this, Nixon imposed a global tariff of 10% on countries around the world. After this it was felt that if such economic emergencies arise in future, the President should have legal powers to deal with such things. For this purpose, “Trade Act 1974” was passed in 1974.

According to the New York Times report, Section 122 has never been used before. Therefore, it is also not clear that if it is challenged in the court, how the courts will interpret it.

Court rebuked Trump, said- not in a state of war with every country

Earlier on Friday, the Supreme Court had reprimanded the Trump administration and said that America is not at war with every country in the world. However, three judges Justice Samuel Alito, Clarence Thomas and Brett Kavanaugh disagreed with the decision.

Kavanaugh wrote in his note that whether the tariff policy was sensible or not is a different question, but according to him it was legally valid. In his note, Kavanaugh also mentioned the tariffs imposed on India for purchasing Russian oil.

He wrote that these tariffs were imposed under sensitive issues related to foreign policy and national security.

There are a total of 9 judges in the US Supreme Court. Of these, 6 judges were appointed by Republican Presidents, while 3 judges were appointed by Democratic Presidents. All three judges who voted against the decision were appointed by Republican presidents.

Justice Brett Kavanaugh was appointed to the Supreme Court on October 6, 2018, by President Donald Trump in his first term.

Court decision does not eliminate all tariffs

The court order has not ended all of Trump’s tariffs. The tariffs imposed on steel and aluminum were imposed under separate laws, so they will still apply.

However, tariffs of two big categories have been banned. The first category is of reciprocal tariffs, which Trump had imposed on different countries. In this, the baseline tariff was fixed at 34% for China and 10% for the rest of the world. After the court decision, these tariffs have become invalid.

The second category is of 25% tariff, which Trump had imposed on some goods coming from Canada, China and Mexico. The Trump administration said that these countries did not take adequate steps to stop smuggling of fentanyl into the US. The court decision has also repealed this 25% tariff.

America recovered 200 billion dollars from tariff, suspense on refund

According to a New York Times report, the Trump administration has levied tariffs of more than $200 billion since the beginning of last year. After the decision of the Supreme Court, now a big question has arisen regarding the refund of this amount.

After the decision, it is not clear whether the government will have to return the money recovered to the companies or not. The Trump administration had earlier said that if the case was lost, it may have to withdraw trade agreements with many countries and pay huge refunds.

Trump imposed tariffs using a 49-year-old law

At the center of Trump’s tariff dispute is a law called the International Emergency Economic Powers Act (IEEPA). This law was made in 1977.

Its purpose was that if there was any serious threat to the country such as a war-like situation, a major economic threat from a foreign enemy or an extraordinary international crisis, then the President could be given certain special powers.

Under these powers, the President can ban foreign transactions, control them or implement some economic decisions immediately. Trump had taken the help of IEEPA to impose tariffs.

Supreme Court had raised questions on tariff

In November last year, the Supreme Court had raised questions on the legal basis of imposing tariffs by the Trump government. During that time the judges had asked whether the President has the right to impose such global tariffs. The court held a long hearing in this matter.

The court said that Trump can impose 15% tariff for 150 days, but a solid reason is required for this. The judgment said that the word ‘tariff’ is not mentioned anywhere in the IEEPA, nor does it place any clear limits on the powers of the President.

12 states had filed a lawsuit against Trump

Trump had announced these tariffs in April last year. Many small businessmen and 12 states of America had filed a lawsuit against these tariffs. He said that the President went beyond his limits and imposed new tariffs on imported goods.

The states of Arizona, Colorado, Connecticut, Delaware, Illinois, Maine, Minnesota, Nevada, New Mexico, New York, Oregon and Vermont, along with small businessmen, had filed this case against the Trump government.

The Trump government had argued in the court that if the tariffs are removed, billions of dollars may have to be recovered. This will be a big blow to the American treasury.

Lower courts declared the tariffs illegal

Earlier, lower courts (Court of International Trade and Federal Circuit Court) had declared the tariffs illegal. He believed that IEEPA does not provide such broad power to impose tariffs.

The Supreme Court heard oral arguments in November 2025, where the judges expressed doubt about the arguments presented by Trump. Despite the Court’s 6-3 majority, the Justices asked whether the President could impose tariffs on such a large scale without Congress’s approval, since tariffs are a form of tax and are the responsibility of Congress.
