The process of refund has started in America after the tariffs imposed during the tenure of President Donald Trump were declared illegal. This is considered to be the largest tariff refund in American history, in which $166 billion (about Rs 13.8 lakh crore) is to be returned. This decision to return the refund has come into effect after the order of the Supreme Court. The court had said that the Trump administration had misused emergency powers and imposed tariffs. After this, the Court of International Trade had directed the importers to return their deposits and interest. Under this decision, there will be relief to about 3.3 lakh importers, who had paid heavy tax on products ranging from car parts to smartphones last year. Applications will be made through CAPE portal. US Customs and Border Protection (CBP) has launched a new portal named CAPE (Consolidated Administration and Processing of Entries). It is part of the ACE (Automated Commercial Environment) system. Through this, importers will be able to submit their claims by filing “CAPE Declaration”, which is claimed to make the process faster and simpler. To get the refund in 60-90 days, the “Importer of Record” and authorized custom brokers will have to register on the ACE portal and provide bank account details. According to CBP, payments can be made within 60-90 days for applications with accurate and complete information. Delays are possible due to lack of documentation or need for investigation. Relief to limited importers in the first phase: CBP has made it clear that not all importers will get refund in the first phase. At present only “unliquidated entries” (for which tax assessment has not yet been completed) and entries made within 80 days have been included. The remaining cases will be taken up in further stages. 56 thousand importers got registered. According to the data presented in the court, about 3.3 lakh importers had paid a total tariff of 166 billion dollars. As of April 9, only 56,500 of these importers have registered in the electronic payment system, which is necessary to get refunds. How much benefit to consumers? According to the New York Federal Reserve Bank, about 90% of the burden of the tariffs was borne by companies and consumers together. Some companies like logistics and retail sector have indicated to provide relief to the customers, but it is not yet clear how much benefit will reach the common consumers. Legal battle still ongoing The dispute over tariffs is not completely over. Companies like Costco had already filed lawsuits against the tariffs. The Trade Court has indicated that several cases will be clubbed together for hearing. At the same time, the government can also appeal against this decision, which may prolong the process. Questions raised on 10% global tariff Meanwhile, the judges of the Court of International Trade have also raised questions on the validity of the 10% global tariff imposed by Trump. 24 states (mostly Democrat-ruled) and small businesses have petitioned against it. The court has asked whether trade deficit alone can be a sufficient basis for taking such a drastic step.
